Gericht verbietet der Telekom DSL-Drosselung
Niederlage für die "Drosselkom": Das Kölner Landgericht hat die Einschränkung von Surfgeschwindigkeiten bei Pauschaltarifen der Telekom für unzulässig erklärt – mit einer einfachen Begründung.

Die Deutsche Telekom hat bei ihren Plänen für eine Tempodrosselung im Festnetz einen empfindlichen Dämpfer bekommen. Verbraucherschützer trugen mit einer Klage gegen den Bonner Konzern wegen der umstrittenen Drosselung vor Gericht einen ersten Sieg davon.
Eine entsprechende Vertragsklausel bei Festnetz-Flatrates erklärte das Kölner Landgericht für nicht zulässig. Das Urteil betreffe sowohl die ursprünglich angekündigte Drosselung auf 384 Kilobit pro Sekunde als auch diejenige auf zwei Megabit pro Sekunde. Damit gab das Gericht einer Klage der Verbraucherzentrale NRW statt.
Das Urteil ist noch nicht rechtskräftig, die Telekom kann beim Oberlandesgericht Berufung einlegen. Das wolle das Unternehmen "voraussichtlich" tun, teilte ein Sprecher mit.
Die Pläne der Telekom für eine Einschränkung der Surfgeschwindigkeit hatten in den vergangenen Monaten für einigen Wirbel gesorgt, das Unternehmen wurde als "Drosselkom" verspottet.
Wer ein bestimmtes Datenvolumen im Monat überschreitet, sollte danach nur noch deutlich langsamer im Netz unterwegs sein, kündigte die Telekom Ende April an. Neue Verträge sollten entsprechend angepasst werden. Technisch sollte die Drosselung allerdings nicht vor 2016 umgesetzt werden. Konzernchef René Obermann begründete die Pläne unter anderem mit den Milliarden-Investitionen für den Ausbau der Breitbandnetze, die zurückverdient werden müssten.
