Thirteen record labels have asked a judge to issue a decision in a 2-year-old case against peer-to-peer software company Lime Wire for allegedly inducing copyright violations of music files.

The motion for summary judgment was filed Friday with the U.S. District Court in the Southern District of New York. The record labels, including Warner Bros. Records, Sony Records, and Virgin Records, are asking the judge for a decision because they claim Lime Wire has "promoted infringement," and has taken no steps to prevent illegal file trading, among other complaints.

The record companies originally filed their suit against Lime Wire in August 4, 2006, alleging "inducement of copyright infringement, contributory copyright infringement, and with respect to pre-1972 recordings, common law copyright infringement and state law unfair competition." They also allege personal acts of copyright infringement by Mark Gorton, the owner of Lime Wire, and CTO Greg Bildson.

Lime Wire, which has filed a similar motion for summary judgment in the case, argues that it is not liable for "vicarious" or contributory copyright infringement because of the Sony-Betamax safe harbor. That safe harbor roughly states that makers of technology used for a variety of purposes are not liable for its creation and distribution so long as the products are "merely capable of substantial noninfringing uses," according to its filing.

IMO it would be very hard to take down such a Monster p2p Organization such as LimeWire,since lots of p2pers already aware of this application ages ago,it got fame from nothing,just as quick as a thunder,so this is gonna be another lost war :tongue:

even if they kill LW, there's frostwire :smile: anyway, the gnutella network (the one limewire operates in) is slowly becoming what kazaa's is now, every time filled more with trojans, decoy MP3s and bots that will answer to all search queries with fakes :mad2: i think that currently Ares is the best soft to download tracks and small files, at least until they destroy this network too. and they have already started :icon_angry[1]:

Mediadefender's 9 gbit connections could be used for good purposes instead...

LOL also that "manageable level" wont be that easy at all,since lots of trackers just solid as rocks & getting more powerful since that private thingy :tongue:

I doubt it will ever... be :wink: Anyway, what do they think they're doing saying they have achieved "major victories" (http://torrentfreak.com/p2p-is-unstoppable/) and that they're aware piracy is both "online and in the street" (http://www.riaa.com/physicalpiracy.php), but intend to "bring it to a level of manageable control" (http://www.riaa.com/faq.php) because it's unrealistic to "wipe it out entirely"? Sounds a bit silly to me, as they first say they're winning against piracy, and then something a little different.

well,dont count on their words at all dude,fake enemies always pretend victory all the time,so this is the same scenario & im sure 100% that they knew @ the begining of this silly campaign that hey wont be able to score anything but u know its always bragging that lead lots of great people to their misery :biggrin:
